New rules for mutual debt compensation

According to Government Decision no. 773/2019, as of 1 January 2020, all mutual debt compensation can only be performed via the Compensation Information System managed by the Training Centre for Industrial Staff, Bușteni (Bucharest branch).

According to information provided by representatives of the aforementioned authority, it is mandatory that all compensation between Romanian legal entities (regardless of the origin of the share capital, value of or period of non-payment of receivables) be made by creating user accounts and sending the invoices for compensation to the dedicated address (https://gama.cppi.ro).

Where this online registration procedure is not respected, there is a risk that companies subject to verification will be awarded fines of between RON 300 and RON 4,000 for violation of the legal provisions governing the preparation and use of supporting and accounting documents for all operations performed and their entry into the accounting during the corresponding period.
