Under Presidential Decree no. 195/2020, which was issued on 16 March 2020 and which enacts the state of emergency in Romania, during the period of state of emergency and in so far as it is possible, private companies can introduce teleworking or homeworking systems by means of a unilateral act of the employer.

An employer may thus implement teleworking or homeworking systems within the company on the basis of a Decision of the Company Administrator, which is to be duly communicated to its employees. The Decision is to be registered in the REVISAL system prior to entry into force.

Outside of the state of emergency, the performance of employment duties via teleworking or homeworking systems is to be agreed by an addendum to the employment contract that must be signed and agreed by both parties (the employee and the employer) and registered with the REVISAL system prior to its entry into force.
